MyBuzz Technologies Ltd, the owners of MyShiftPlanner, are committed to protecting and respecting your privacy when you use our products and services.

This Privacy Notice explains how MyShiftPlanner® (“the app”, “we”, “our”) collects, uses, and protects your information. We want you to understand what data is processed by the app itself, and what data may be processed separately by the Apple App Store or Google Play Store when you download or use MyShiftPlanner.

This Privacy Policy explains:
  • the personal data we collect from you when you use MyShiftPlanner® and related services
  • what data may be processed by Apple or Google separately when downloading, using or subscribing to our app
  • how we keep your data secure
  • how you can contact us

The purpose of MyShiftPlanner® is to provide a personal shift planning tool to help you manage your work and personal life more easily.

MyShiftPlanner® is provided as a tool to assist shift workers – i.e. those employed. As such, the app is NOT intended to be used by anyone under 16 years of age.

The app doesn’t provide features to create shareable content, display unrestricted web or social media content or access sensitive information which would be inappropriate to those under 16 years of age.

The nature of the MyShiftPlanner® app means that you may – at your own choice – input personal information into the app to allow you to gain most benefit from it.

We aim to process as little personal information as possible. Most of your shift information stays on your device unless you choose to back it up or share it.

There are OPTIONAL “add-on” services you can choose to use or purchase, some of which require you to provide personal details such as an email address, in order to gain the most benefit.

These are clearly marked within the app, and also described in more detail within this document.

It is your choice whether you wish to provide this information, and therefore whether you will be able to subscribe, purchase or use any add-ons within the app.

If you choose to use our Service or app, then you agree to the collection and use of information in relation to this policy.

The Personal Information that we collect is used for providing and improving the Service.

We will not use or share your information with anyone except as described in this Privacy Policy.

MyBuzz Technologies Ltd strictly adhere to the EU, EEA and UK General Data Protection Regulation (GDPR) and are registered with the Information Commissioners Office (ICO) in the UK.

We also adhere to ePrivacy Directive (EPD) in the EU, and US state Data Protection regulations (CPRA, SPA and VCDPA) regarding collection, consent, storage and use of your data.

The Data Controller determines the purpose and means of processing personal data collected by the MyShiftPlanner® app and services. The Data Controller is:

BASIC INFORMATION COLLECTION AND HOW WE USE IT

Within the basic app, you can optionally provide the following personal information:
  • Your first and/or last name
  • Your profession
  • Your country (in which you are using the app)
  • Your location of work
  • Your employee ID
  • Name of your employer/place of work

Unless you choose to use the CLOUD-BASED services by creating an account in the app as described below, all of this information is stored ONLY on the device.

Note – if you use a backup system such as iCloud or Google Drive to backup your device, this information may also be stored on these backup services as part of your device backup data.

We have no control over these backups, where or how these files are stored and protected so can’t be held responsible for any misuse, loss or leak of these files from these locations.

The above information is used to provide a better user experience, such as providing the correct Public Holidays for your country on the calendar. Should you choose not to provide them, the app will continue to function but may show incomplete or incorrect information to you.

ADVERTISING and CONSENT

The free version of our app displays advertisements. These fund the continued development of the app, new features, maintenance and great support we offer. Without this revenue the app wouldn’t be able to provide a free version of the app.

When you first install MyShiftPlanner® as a new user you will be placed into the free version by default, and advertising will appear. You can choose not to see adverts by upgrading to a paid subscription at any time.

The first time you run MyShiftPlanner, if you are using the free version (with adverts) you may be asked to make a choice about whether you wish to see personalised or general (non-personalised) adverts in your app.

The choice will appear as follows:

  • For ALL users, you will see a consent dialog. Use the options to make your decision about how we can use your data to tailor your adverts.
  • For Apple (iOS) users, after making a consent choice, you will be shown an option for App Tracking and Transparency. This is a standard Apple pop-up which we legally must show but allows a further choice of how your ads may be personalised.

For data protection and legal reasons, you must make a choice to use the app if you are presented with the consent screens.

NOTE: Whichever choice you make, you will continue to see adverts in the app, but they may be less relevant to you.

Advertising Partners

For advertising services, we use Google AdMob which provides the adverts from themselves and selected advertising partners. These adverts are shown at different places within the free version of the app, such as at the bottom of the screen.

Google advertisements will not be shown if you have purchased a relevant product from us, such as the Pro Pack or No Ads/Remove Ads add-on within the app.

Note: during trial access to a paid subscription or feature, at our discretion we may continue to display adverts. However, once the trial period had concluded and a purchase is confirmed with payment, all adverts will be removed from our app.

Our app deliberately restricts adverts to stop high risk or inappropriate adverts from showing withing our app. This includes, but is not limited to, adverts of a sexual, political or racial nature.

We have opted out of displaying adverts related to children as our app is not intended for use by anyone under 16 years of age.

Any inapprioriate ads that slip through the Google AdMob filters can be reported for removal to Google through the icon in the top corner of the advert, or directly to our support team at: support@myshiftplanner.com

1. If you have consented to show Personalised Adverts (by choosing “Consent” in the consent screen, and/or Allow App Tracking in the iOS privacy pop-up):

Our advertising partners may optionally use data from your phone, purchase or web history to personalise the adverts shown to you.

Specifically, they may collect:

  • Previous search activity
  • Your activity while you were signed in to Google
  • Your previous interactions with ads
  • Types of websites you visit
  • Types of mobile app activity on your device
  • Your activity on another device
  • The time of day
  • Info you gave to an advertiser, like if you signed up for a newsletter with your email address

IMPORTANT: The advertisers NEVER get access to direct contact details such as Email, your name, address or phone numbers (where applicable).

WE DO NOT COLLECT OR HAVE ACCESS TO THIS INFORMATION ourselves. It is collected directly and automatically by Google from your device using official APIs. We accept no responsibilities for any misuse, loss or leak of this data by Google.

2. If you chose not to consent to personalised adverts opted out of App Tracking:

  • Adverts shown will NOT be based on any details about you, and no details about you will be shared with the advertisers.
  • Adverts will still appear in the app but they will be more generic and less relevant to you.

Interacting with Adverts

Interacting with the advertisements (e.g. tapping on one) is your choice. If you choose to interact, it may open another app, website or pop-up of the ad providers choosing. This will be outside of MyShiftPlanner® and not controller or monitored by us.

These external sites are not operated by us and we cannot be held responsible for them. Therefore, we strongly advise you to review the Privacy Policy of these websites before continuing to use them or before providing them with any personal data.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Any issues with those third party services must be raised directly with the third party.

If you have concerns about any particular advertisement, or wish not to see them, tap on the triangular icon in the top-right corner of the advertisement for options on how to report this ad directly to Google.

Opting Out of Personalised Ads / Changing your Consent Choice (where applicable)

1. You can change your consent choice in MyShiftPlanner® v6.3 as follows:
  • Tap the menu icon in the top-right of the app screen
  • Tap User Profile
  • Tap Reset Ads Consent
2. In earlier versions of MyShiftPlanner, or where consent is not required:
  • This can be done through your device “Settings” app, within the “Privacy” area. The option is often referred to as “Tracking” or “Ads Opt Out”
  • Each device provider and OS version has a different location and name for these settings, so we recommend referring to the device user manual for details.

YOUR MyShiftPlanner® CLOUD ACCOUNT

Creating an account with MyShiftPlanner® is OPTIONAL.

With a free cloud account, we offer a number of services such as data backup, sync between devices and personalisation of your app. If you choose not to create an account, you are responsible for backing up your app data through some other means.

To register for a MyShiftPlanner® Cloud Account, we requiring the following information to be provided:

  • A valid email address (used as the user ID for your account and must be unique)
  • A strong password meeting our security rules (6 or more characters, with at least one capital letter and a number or symbol such as ?!.# or space)

Once created, MyShiftPlanner® Cloud account will automatically send any personal data provided within the app (as described in the previous section) to our servers in order to complete the user profile.

If you prefer NOT to have this information stored on your MyShiftPlanner® Cloud account, please DO NOT register for an account, or leave the information blank within your app.

If you choose to use the on-line Backup facilities of your MyShiftPlanner® Account, your entire database from the app will be sent (securely) to our services, where they will be stored according to our data retention policy.

Any personal data you include in your app will also be included in the backups stored on our servers.

The Live Sharing feature of the PRO Pack require a MyShiftPlanner® cloud account. If you prefer not to register for a MyShiftPlanner® account, please check that the PRO Pack features still provide sufficient value without these features.

All your data is stored securely on our servers, encrypted and with strict access controls and monitoring measures in place. All data sent to/from our servers, and through your account, is encrypted in transit using the highest levels of transport security.

INFORMATION WE COLLECT DURING SUPPORT CASES

If you choose to contact our support teams through the app or directly via Email, Facebook, Twitter or Instragram, we will retain your direct contact details and information provided to us about the support incident within our support systems.

This data may also include a copy of your app log files and/or data files if you choose to include them at the time you submit the support ticket.

While the incident is on-going, we will use the provided contact details to contact you about the incident, and may use any provided data files to help us reproduce the issues you’re having in order to help solve your problems.

If we have difficulty contacting you during a support incident raised by you, we may use alternate contact details such as alternate email addresses within your account to contact you.

Any details provided during an incident will ONLY be used for that incident, and will never be used for any other purpose – such as sales or marketing.

If you prefer us not to use your data files during an incident, please let us know as soon as possible or remove the files from the generated email before sending to us.

There is a clear option within the Help/Support form in the app which allows you not to include your data files should you prefer not to.

Note: if you choose not to send your data files, it may restrict the amount of support we can provide or severely lengthen the time it takes us to resolve your issue.

HOW THE APP STORES (APPLE & GOOGLE) PROCESS YOUR DATA

When you download, update, subscribe or purchase through MyShiftPlanner, the app stores may collect and process information independently from us.

This can include:

  • Account information (Apple ID or Google Account)
  • Country or region
  • Device model and OS version
  • Purchase history
  • Fault/diagnostic reports

They use this data to:

  • Deliver the app to your device
  • Process payments
  • Manage your subscriptions
  • Detect fraud or misuse
  • Improve their platforms

We do not control this processing.

PURCHASES and PURCHASE TRACKING

All purchases are made on our behalf through the App Store as appropriate for the device you purchase from. The App Store providers take, process and manage all purchases and money transfers on our behalf.

We DO NOT directly collect or store any credit card or personal financial information.

We CANNOT take payments without your explicit approval through the purchase process.

You are required to instigate all purchases, which often needs your physical approval via fingerprint, face detection or other security measure employed by the App Store provider.

Any purchase or subscription attempt through the mobile app may also require parental approval in certain countries or states in accordance with SB2420 (App Store Accountability Act) if the person initiating the purchase is under 16 years of age.

This is handled automatically by the relevant app store. We do not have any access to, or control over this process or its outcomes.

The App Store owner may choose to keep personal data about you in accordance with their privacy policies, data use policies or terms in order to provide you with the services. Please refer to the relevant app store provider’s policies for more information.

We will NEVER automatically sign you up for a chargeable subscription, add-on or product. The default mode of the App is the free tier with advertisements.

You can optionally choose to purchase additional features through the purchase options within the app but these are your choice. If you wish to cancel any purchases, you must contact the relevant App Store operator as we have no access to your transaction information. We will happily assist you in finding the correct contact details if you wish to do this.

If you wish to see all purchases made within MyShiftPlanner, open the app menu inside MyShiftPlanner® and tap “Manage Purchase History”.

This screen also includes a convenient link to the App Store purchase area where you can see even more details about your purchases and cancel or change subscription at any time.

We store information about your purchases on our servers in order to provide the appropriate features and services relevant to your purchases. This information includes:

  • Date and time of purchase
  • Type of product purchased
  • Expiry Date
  • Cancellation Date and Reason
  • Subscription or Purchase Status
  • A link to your MyShiftPlanner® Cloud Account if logged in at the time or or subsequently following the purchase.

You can cancel any MyShiftPlanner® subscription at any time through your phone settings:

  • For Apple: open the Settings app on your phone. Tap the area at the top to access your iCloud account. Tap “Subscriptions” to manage it from there.
  • For Android: open the Play Store app on your phone. Tap your profile icon in the top-right of the app screen. Tap “Subscriptions” to manage it from there.

We DO NOT have any access to your Apple or Play Store accounts, nor to cancel any purchases or subscriptions on your behalf. You are required to do this through your phone as described above.

If purchases are cancelled or subscriptions expire, the relevant features or services will be removed from your App or Account in accordance with our Terms and Conditions.

Note: if a subscription is cancelled, the features may still remain active until the end of the current paid subscription period.

Note: once purchase are cancelled by the provider, they are blocked by the provider so you will not be able to re-purchase them through the app in future.

MONITORING AND AUTOMATICALLY COLLECTED DATA

We automatically collect anonymous usage information from your app to allow us to monitor for problems and security issues. We do this in order to be able to provide the shift scheduling service to you.

The data collected by our automatic monitoring systems includes:

  • Device Make and model of the device
  • Country where the app is being used
  • Language of your device and timezone
  • IP address (to detect hacking attempt or misuse)
  • Data and time that the app was opened (to determine number of active users on our platform)
  • Crash and error information raised by the app
  • Basic activity within the app so we can identify underused features or problems with the user experience within the app. These are collected anonymously so never tracked against an individual. The tracked activity includes:
  • Opening of screens within the app
  • Use of specific features within the app
  • Purchases
  • Error generated within the app which you may or may not see

This information does NOT contain any sensitive personal information or contact information, nor is it used for anything other than monitoring our service and to detect breaches or security issues.

None of the information collected (as described above) is used for marketing purposes, nor is it shared with any other party for marketing purposes.

We use a mix of third party and bespokely created services to collect this information, including:

  • Google Analytics
  • In-built App Store monitoring and error collection tools
  • Priorietory monitoring tools developed by MyBuzz Technologies Ltd.

If you would prefer this information not be collected from your device then please delete the app and cease using it immediately.

MARKETING AND COMMUNICATIONS

All data we collect, and that you provide, will never be sold or shared with third parties for marketing purposes.

If you have opted to receive information from us via the app, we may, from time to time, contact you with relevant MyShiftPlanner® or shift related information we believe may be of interest. We NEVER share your contact details to other partners or companies.

One of our communications is for our newsletter published by us. This contains tips on best use of the app, news about app updated, “coming soon” news about new features, shift-related or interesting articles, and more.

If you have opted in to receive communication from us, then we will send this to you when available.

You can opt out of receiving this newsletter at any time by using the unsubscribe link at the bottom of this email or within the User Profile > Communication screen in MyShiftPlanner.

Note: the option to opt out of the newsletter or communication is for marketing only.

We reserve the right to message you with important system/account related information, or in response to a support request should you choose to contact our team.

We are permitted to do so under data protection regulations and is necessary to perform our services to you. These messages will never contain marketing or sales content.

HOW LONG WE STORE YOUR DATA

Your personal data, such as your backups and MyShiftPlanner® Cloud account details, will be retained for as long as you are using the app and service.

Backups older than 12 months may be deleted at our discretion to help control our data storage use.

We keep a maximum of 6 most recent data backups for each user. We may choose to reduce this at our discretion. We are under no obligation to retain specific backups, or retain them for any specific length of time.

Due to the nature of Mobile Apps and the App Stores, we aren’t informed if you delete MyShiftPlanner® or choose to stop using it. As such, we can’t delete your account automatically in these cases.

However, you can choose to delete your account at any time either through the User profile screen in the app, or by contacting us to request a deletion.

If your account is deemed to be unused for 6 months or more, we may automatically disable your account and delete it (with all data and backups). We do this to protect your privacy and as maintenance for our systems.

Anonymised data collected for monitoring and security purposes will be retained for at least 12 months in order to allow us to provide historical evidence if required during any data breaches or security incidents.

HOW TO DELETE YOUR ACCOUNT

You can choose to delete your account at any time:

  1. Through the app (easiest)
  2. By contacting our support team at support@myshiftplanner.com

To delete through the app, it must still be installed on your device and you must be logged into the app with the account you wish to delete.

  1. Tap the app menu icon (in the top left of the app screen)
  2. Tap User Profile
  3. Scroll to the bottom of the user profile screen
  4. Tap Delete My Account and follow the prompts to confirm.

Once deleted, your account removal is permanent. We will not be able to recover your account after deleting.

Deleting your account will remove all information about you from our database, including all your data, backups, shares and other information.

If you have shared your data with someone else, it may still appear in their app if they are not logged into their account or are not connected to the internet. In this case, you will need to contact them directly and request that they remove your data, as we do not have any means to do this remotely in these situations.

YOUR RIGHT TO BE REMOVED

If you choose to stop using MyShiftPlanner, deleting the app will NOT automatically remove your account details, backups or profile information we have stored on our servers related to you.

To request that your data be removed from our systems, including all backups relating to your account, you can either:

  1. Use the Send Feedback tool in the app menu, choosing “Please Delete My Account and Data” as the Feedback Type
  2. Contact us directly via email: support@myshiftplanner.co.uk

On receipt of this request we will remove your data within 2 working days.

REMEMBER: if you choose to re-install or use the app after the removal request has been completed, details will continue to be collected and a new removal request may be required in future.

SERVICE PROVIDERS

We employ trusted third-parties due to the following reasons:

– To facilitate our Services to you;

– To provide part or all of our Services to you on our behalf;

– To provide relevant advertising to you if using the free tier of the app;

– To assist in analyzing how our Service is used, to allow us to provide the best quality service and products we can to you.

However, third parties are only provided with access to your data on a ‘strictly needed’ basis, and limited to only the specific data required at that time. For more information about what information is captured for advertising purposes, and how you can limit this, please see the section at the top of this document related to advertising.

All third parties are obligated not to disclose or use the information for any purpose other than that permitted by MyBuzz Technologies Ltd.

SECURITY – INTERNET

We value your trust in providing us your Personal Information.

To best protect your data, use commercially recognised and accepted techniques and systems to protect it.

Your data is always encrypted when being transmitted to and from our servers, and we have active monitoring and auditing facilities to ensure the best possible levels of service, security and confidence.

However: No method of transmission over the internet or method of electronic storage is 100% secure or reliable. We highly recommend that you avoid using public Wifi hotspots or other known security risk areas if you are concerned about the security of your data.

SECURITY – DEVICE and APP

Your data is only as secure as the password used for your MyShiftPlanner® account, so it is your responsibility use strong, hard-to-guess passwords and to keep this password safe. Do not disclose it to anyone else.

We also highly recommend using the security measures provided with your device, such as FaceID, Fingerprint Locking or PIN code locking to make sure only you can access your device and the apps installed on it.

If you believe that your password or account has been compromised, you can either reset your password directly from within the User Profile section of the app, or contact our support team for assistance.

It is your responsibility to ensure your data is not compromised or lost due to theft, unauthorised access to your device(s), damage or loss of your device. We will assist as far as possible in these cases but cannot be held responsible for any losses incurred in these cases. We highly recommend using the Backup facilities within MyShiftPlanner® to help keep your data safe.

CHILDREN’S PRIVACY

MyShiftPlanner® nor any of its related services are intended for use by anyone under the age of 16. We do not knowingly collect personally identifiable information or advertise to children under 16.

MyShiftPlanner® app is designed, marketed to and intended to be used by people of working age to manage their shift working rotas. This is expected to be people over the age of 16 so the app is designed and supported as such.

In the case we discover that a child under 16 has provided us with personal information, we immediately delete this from our servers.

If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us as soon as possible.

The ads which show in our app are tailored for the intended audience of shift workers aged 16 or older. We actively block the most sensitive categories of ads (such as anything sexual or illegal) as far as we are able through the tools provided to us by the ad providers.

SUBJECT ACCESS REQUESTS

You may request, at any time, a disclosure of all information we hold about you, by contacting us at: support@myshiftplanner.com.

This is referred to as a Subject Access Request.

Any Subject Access Requests will incurr an administration fee of £10, payable in advance and will require you to provide a valid email address we can send it to.

The report will usually be provided within 14 days of receipt of cleared payment.

The report will be sent to you in a standard Microsoft Office compatible format, by email.

It is illegal for us to disclose to you information pertaining to us reporting our suspicions concerning your criminal behaviour or of ongoing criminal or regulatory investigations concerning your information.

CHANGES TO THIS POLICY

We may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Privacy Policy onto our website and as an update within the app. These changes are effective immediately after they are posted on this page.
